Before using medi-wing.com and any other websites, mobile applications, or social media accounts (collectively, "Site" or "Medi-Wing", "us", "we," or "our") run by MEDI-WING and/or its affiliates and/or subsidiaries (as applicable), please carefully read these terms of use ("Terms").

By using or otherwise accessing the services and/or by creating an account with us, you agree to the terms of this agreement, including the information practices disclosed in our Privacy Policy. If you do not agree with this agreement, you cannot use the services. If you create an account or use the Services on behalf of an individual or entity other than yourself, you represent that you are authorized by such individual or entity to accept this Agreement on such individual’s or entity’s behalf.

We do not provide medical advice

The Content (other than the information you receive from Healthcare Professionals) that you obtain or receive from Medi-Wing, its employees, contractors, partners, sponsors, advertisers, licensors or otherwise through the Services, is for informational, and scheduling purposes only.

The information on the Site, including but not limited to any videos, text, graphics, and photographs (as well as information from users, staff, and our licensors), is exclusively for educational and informative purposes. The Content cannot and should not be used as a replacement for expert medical guidance, diagnosis, or treatment. Make no health-related choices based on any of the Content. Any queries you may have concerned a medical problem or any questions you may have about your health should always be directed to your doctor or other trained health practitioners. Any tests, doctors, products, treatments, views, or other information that may be mentioned on the site or in connection with appointments made through the site is not endorsed or recommended by us.

Any medical professionals or partners who publish on the site are obliged to identify any such conflicts of interest. We do not suggest or support any medications, tests, physicians, products, treatments, viewpoints, "off-label" drug usage, or other material that may be stated. You use the Content at your own risk and should not rely on it in any way. You entirely assume all risks if you rely on any information posted on the site at our invitation or by other site users. Call your doctor, 999, or the nearest emergency services as soon as you suspect a medical emergency.

Use of Site

Healthcare providers may use the services to share content with you. Medi-Wing encourages Healthcare Providers to use the Services responsibly, but we have no control over, and cannot guarantee the availability of, any Healthcare Provider at any particular time. We will not be liable for cancelled or otherwise unfulfilled appointments, or any injury resulting there from, or for any other injury resulting or arising from, or related to, the use of the website or Services whatsoever.

Where banned, use of and access to the Site are invalid. By using the Site, you affirm and warrant that (a) all registration information you provide is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older or have parental or guardian permission, and (d) your use of the Site does not conflict with any requirement you may have to a third party or with any law or regulation that may be in effect. Except in circumstances where Medi-Wing engages in separate agreements with you, Medi-Wing presently provides users with access to the Site free of charge; nevertheless, Medi-Wing reserves the right to impose fees at any point in the future for your use of the Site.

Copyright Infringement

Doctors and medical institutions grant medi-wing.com permanent, royalty-free, unalterable, non-exclusive rights and licenses to use, copy, modify, adapt, publish, translate, create derivative works from, incorporate, and distribute their content in any known or future way. Intellectual property rights, such as copyright, trademark, and service mark, are exclusively owned by MEDI-WING.

The users of Medi-Wing are expected to treat others' intellectual property rights with respect. If properly alerted that any user material violates the intellectual property rights of a third party, Medi-Wing will immediately delete it. At any time, it may also do so without giving users any warning. As required by the Digital Millennium Copyright Act of 1998 (the "DMCA"), MEDI-WING has a policy of promptly responding to copyright holders who claim that content on the Site violates their rights.

 Disclaimer

Your use of the website is at your own risk and discretion. The Website Is Provided "As Is" And "As Available" Without Any Warranties from Us. Concerning the website and the services made available through it, we expressly disclaim any warranties of any kind, whether express, statutory, implied, or otherwise, including without limitation, any warranties of title, merchantability, fitness for a particular purpose, or non-infringement. We make no representations or warranties, either express or implied, as to (I) the security, accuracy, timeliness, reliability, or operation of the site; (II) the absence of errors or the accuracy of any errors; (III) the reliability, timeliness, quality, currency, completeness, or usefulness of any information provided by the site.

No recommendation or information oral or written you get from us shall constitute a warranty that is not specifically expressed in these Terms. You entirely assume all risks if you decide to rely on such information. Certain guarantees cannot be excluded in some states or jurisdictions. Some of the exclusions listed above might not apply to you as a result. When using this site, data and content are transmitted across a means that may be outside the realm of our authority and/or that of our providers. If data or other information is transmitted in conjunction with the Site, Medi-Wing disclaims all obligation and accountability.

 General limitation of liability

While we’re always improving, and we hope you have an excellent experience with Medi-Wing, your sole and exclusive remedy for any dispute with us is the cancellation of your account. This can be done by using "Contact Us" feature in the app and requesting to cancel your account.

In no event shall we be liable to you (or to any third party claiming under or through you) for any indirect, special, incidental, consequential or exemplary damages arising from your use of, or inability to use, the app and/or the services. These exclusions apply to any claims for lost profits, lost data, loss of goodwill, computer failure or malfunction, any other commercial damages or losses, or medical malpractice or negligence of healthcare providers utilized through use of the services Termination.

We reserve the right, if we determine it is best, to terminate, suspend and/or deactivate your account immediately, without notice, if there has been a violation of this Agreement or other policies and terms posted on the website or through the Services by you or by someone using your Credentials. We may also terminate, suspend or deactivate your account for any other reason, including inactivity for an extended period. Medi-Wing shall not be liable to you or any third party for any termination, suspension or deactivation of your access to the App and/or the Services. Further, you agree not to attempt to use the App and/or the Services after any such termination, suspension or deactivation. Miscellaneous

No Agency or Partnership. 

The parties are not each other's legal representatives, agents, partners, or joint ventures in any way because of these Terms. The parties are not permitted to bind the other in any way, whether legally, advantageously, or otherwise, or to impose any stated or implied duties or liabilities on the other party's behalf or in that party's name.

Eligibility

You must be 18 years of age or over to create an account with us or use the website and the Services. If you are between the ages of 13 and 18, you can use the website or Services only under the supervision of your parent or guardian who has agreed to these Terms of Use. Those under the age of 13 may not use the App or Services. Parents or legal guardians of a child under the age of 18 may use the App or Services on behalf of such minor child. By using the website or Services on behalf of a minor child, you represent and warrant that you are the parent or legal guardian of such child, and that all references in these Terms of Use to "you" shall refer to such child or such other individual on whose behalf you have authorization to enter into these.

Notice

All notices under this agreement must be in writing and delivered physically, sent by certified mail with a return receipt requested, sent by a nationally recognized overnight delivery service, or sent to us via email at info@medi-wing.com, if we are the recipient. A notification is valid from the date of personal delivery, the date of receipt if sent by certified mail, the date of sending if sent by email, and the date of personal delivery if sent by hand.

Governing Law and Venue

These Terms will be governed by and interpreted in accordance with the laws of the State of Bangladesh, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Bangladesh for the resolution of any disputes. The customer acknowledges that courts will be the only venue for any legal or equitable action of any kind taken by or against us connected to or arising out of these Terms, without regard to any considerations of conflict of laws.
